Ms Lawson attended the hearing for the landlord. The tenant did not attend. The tenant had been given permission to attend the hearing via telephone. The Tribunal tried to contact the tenant by telephone on 3 occasions. On all 3 occasions the call went to answerphone. The hearing proceeded in the tenant’s absence.

The first hearing for this matter took place on 26 July 2024. The matter was adjourned to allow the tenant to appoint a representative.

Shortly before today’s hearing, the tenant provided to the Tribunal a statement asserting that she had made the rent payments and was not in arrears. The tenant provided several statements from Wise Payments Limited as evidence (the “Wise Statements”).

At the hearing, Ms Lawson provided an updated rent ledger which provided that the tenant was over $4,000 in rent arrears and had been in arrears for at least 21 days. Ms Lawson was referred to the Wise Statements. Ms Lawson advised that apart from 3 payments, the Wise Statements were correct. Ms Lawson was asked to check the landlord’s bank account on the relevant dates to see if the missing 3 payments had in fact been made into the landlord’s bank account.

Following a short break, Ms Lawson advised that the missing payments had been made into the landlord’s bank account but not transferred to the rent ledger. Ms Lawson confirmed that the tenant was not in rent arrears and had not been in rent arrears for at least 21 days. Ms Lawson said she believed the rent ledger was incorrect because the reference for the missing payments in the Wise Statements was to 274 Whitehall Road instead of 280 Whitehall Road.

The landlord’s claims for termination of the tenancy and payment of the rent arrears are dismissed.

In the statement provided by the tenant, she asserted that the landlord had breached its obligations including by failing to comply with the Healthy Home Standards. The tenant is advised that if she wishes to pursue claims against the landlord, the statement is not sufficient. She will need to lodge an application with the Tribunal and pay the required filing fee.

The landlord had requested a suppression order. However, the landlord has not wholly or substantially succeeded in the proceedings. Therefore, the application for suppression is also dismissed.
