Auckland Refugee Council Incorporated is granted possession of the boarding house room and all facilities of the boarding house at Room 5, or any room subsequently occupied, 229 Blockhouse Bay Road, Avondale, Auckland 0600 at 5pm Sunday 10 November 2024.

Reasons

Both parties attended the hearing. This was a rehearing after this was ordered (dated 20 August 2024) by the first adjudicator. Mr Dawit Arshak represented the landlord.
A court-appointed Spanish interpreter was present.
The landlord has applied for possession of the premises occupied by the tenant.
The premises is a boarding house room. The premises contains eight bedrooms and a sleeping capacity of up to 16 tenants.
This arrangement is a boarding house as intended by Part 2A Residential Tenancies Act 1986 (“RTA”). The tenancy agreement as signed is appropriate for such a tenancy.
The landlord has given the tenant notice terminating the tenancy and the tenant has not quit the premises within the period specified in the notice. See section 66U(1)(d) and 66Y RTA. No reason from the landlord is required for such a notice.
The notice was correctly served on 22 March 2024, with an end date of 20 May 2024 set.
The landlord lodged this application on 20 May 2024, after the tenant did not vacate by that date.
The tenant provided a number of supporting documents detailing her background and some other issues and concerns. As explained at the hearing, these do not have a direct bearing on the determination of the landlord’s application as lodged. They are acknowledged and it is hoped the tenant is able to access and accept appropriate support to assist in her move.
The landlord is entitled to an order for possession of the premises. See section 66Y(2) RTA. That sub-section requires, if the Tribunal is satisfied that the notice of termination was properly given and has not been withdrawn, it must make an order granting possession of the premises to the landlord.
