The Tribunal may hear matters in the absence of a party where satisfied that notice of the hearing has been given. I am satisfied that notice of the hearing has been given.

The landlord has applied for possession of the premises following the termination of the tenancy.

A notice terminating the tenancy pursuant to s.53B Residential Tenancies Act 1986 (“RTA”) was served on the tenant by letter dated 15 February 2024. The notice recorded that the tenancy would end on Monday 3 June 2024.The tenancy has ended and the tenant remains at the premises.

Section 53B RTA provides that a landlord may terminate a tenancy by giving at least 90 days’ notice where: • The tenancy was granted before 14 April 2014. • The landlord is Kainga Ora. • Kainga Ora requires the tenant to transfer to different social housing provided by Kainga Ora • Kainga Ora considers the transfer to be necessary or desirable. • The other proposed social housing is appropriate for the tenant’s housing needs.

Does this application comply with the requirements of s.53B RTA ?

The tenancy commenced on 24 April 2008.

The landlord is Kainga Ora.

Kainga Ora requires the tenant to move to different premises which are also provided by Kainga Ora.

Kainga Ora considers the transfer to be desirable or necessary. The tenant has refused to allow Kinga Ora contractors and staff access to the premises to carry out work so as to comply with Healthy Homes requirements. The Healthy Homes compliance work which was required to be completed by 1 July 2024.

Kainga Ora have suitable alternative premises available.

The tenancy ended on 3 June 2024, which is less than 90 days ago. The requirements of section 64(1) RTA are satisfied.

At the request of the landlord, I have made the possession order conditional upon access being granted by the tenant to Kainga Ora by no later than 11.00 am on Friday 5 July 2024 to carry out the necessary work. If the tenant fails to give the landlord access to the premises by that time, then possession of the premises will be granted to the landlord at 11.59am on Tuesday 23 July 2024.
