- The tenancy of Angus MacRae at Unit/Flat 22, 26 Dover Street, St Albans, Christchurch 8014, Dover Courts is terminated, and possession is granted to Otautahi Community Housing Trust, at 5pm Sunday 25 August 2024.
- Angus MacRae must pay Otautahi Community Housing Trust $1745.73 immediately, calculated as shown in the table below:
Reasons
- Both parties attended the hearing, conducted via teleconference.
- This a rehearing after a tenant application for such.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy is as ordered.
- The bond was released to the landlord previously and is applied against the debt in this order.
- Mr Macrae raised issues regarding the premises. He was advised on the need to lodge a tenant application if he wants to pursue these claims.
- Because Otautahi Community Housing Trust has wholly succeeded with the claim I must reimburse the filing fee.
