Is the tenant responsible for the damage to the premises?

The landlord claims the tenant damaged the premises by making holes in the walls to attach various items to the walls such as artworks, televisions, and a baby safety gate. The landlord also says the tenant dented some walls and that they removed some blinds, a towel rail, and cupboard handles. The tenants also marked various doors and walls with markers and damaged a ceiling access hatch.

The landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage.

I am not satisfied that all the damage was more than fair wear. A modest adjustment to account for some minor dents being only fair wear and tear is needed. Further, the walls needed to be repainted in year or two, so adjustment for depreciation is needed.

The contractor invoiced the landlord $3,975.70. I reduce that figure to $3,450.00. That is the amount the tenant must pay towards the damage. 1 Residential Tenancies Act 1986 (RTA), s 40(1)(e)(iii). Filing fee

The tenant must reimburse the landlord for the filing fee. Bond

Tenancy Services is directed to pay the bond to the landlord. That will go towards the tenant’s debt to the landlord.
