- The tenancy of Zarna Lawson at 135 Osprey Drive, Welcome Bay, Tauranga 3112 is terminated, and possession is granted to Accessible Properties New Zealand Limited, at 11:59pm on 6 September 2024.
- Zarna Lawson must pay Accessible Properties New Zealand Limited $4,918.73 immediately, as calculated below: Rent arrears to 29 August 2024$2,423.14 Utilities to 30 May 2024$2,468.59 Filing fee$ 27.00 Total award$4,918.73 Total payable by Tenant to Landlord$4,918.73
Reasons
- The landlord attended the hearing. The tenant did not attend and did not answer when telephoned on the number on the application form and ending in 952.
- The landlord has applied for termination of the tenancy, rent arrears and outstanding utilities.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy of $2,423.14 through to 29 August 2024. I have granted possession of the tenancy to the landlord on 6 September 2024. I do not know the exact date that the tenant will vacate the tenancy and note that the tenant remains liable for further rent until they do vacate.
- The landlord has also provided records for outstanding utilities which prove the among owing of $2,468.59 for water usage charges and a skip bin through to 30 May 2024.
- Because Accessible Properties New Zealand Limited has wholly succeeded with the claim I must reimburse the filing fee. R Harvey-Lane 27 August 2024
