Reasons

Both parties attended the hearing.

The tenancy came to an end on 1 October 2024. The partes have been in dispute over three payments of rent that the tenants say have not been taken into account in terms of the landlord’s rent summary.

The tenants have consistently said they made three payments that the landlord has not taken account of in their rent summary. T he payments were $670, each paid on 26 June, 31 July and 14 August 2024.

The matter has been previously adjourned as further information has come to light. This information included information from the tenant’s bank account showing the money going out of her account and not bouncing back.

A letter was produced by the tenant at one point (not on bank letterhead) for each of these three payments, showing the name and bank account number the money was paid to, being the same bank account number of the landlord and recorded on their own bank statements.

The landlord’s corresponding bank statements showed no money coming in from the tenants on those days.

The parties have the same Bank.

Following one of the hearings, the parties agreed that since the parties had the same bank, the landlord’s banking representative would contact the tenant to discuss futher.

That conversation took place and the tenant said that the bank has told her that the payments in fact went to a different bank account number of somebody by the name of Katrina. She does not know anyone by that name.

At the last hearing, the landlord produced a letter dated 10 June 2025 from the bank confirming that the name of the account t h e t e n a n t h a d p a i d t h e m o n e y t o is the landlord’s name but the bank account number was totally different. Therefore the payments were not received by the landlord at all.

The matter was adjourned because the tenant was on her way to hospital and had not seen the letter.

She has not offered any challenge to the letter although claiming still she has paid the landlord.

It is the landlord’s obligation to prove their claim on the balance of probabilities. I am satisfied the evidence establishes that the rent ordered above is owing and that the three payments more probably than not did not reach the landlord.

Because Compass Property Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
