Reasons

This application was scheduled to be heard by teleconference. I rang the number provided for the tenant twice. On the first occasion the call went to voicemail and I left a message saying that I would ring back in 5 minutes. I rang back in 5 minutes and again my call went to voicemail.
The hearing proceeded in the tenant’s absence.
The landlord has applied for termination of the tenancy and payment of rent arrears.

Should the tenancy be terminated?

At today’s hearing the landlord expressed a wish that the Tribunal order a conditional termination in which the tenant would be ordered to pay an agreed amount to pay back rent arrears.
The landlord stated that there was an existing arrangement whereby the tenant was paying an amount over and above the rent in order to pay the rent arrears. She stated that she wished to formalise this arrangement with a Tribunal Order.
However the Tribunal can only write up a conditional termination agreement if both parties attend the hearing and confirm the arrangements.
The tenant did not attend todays’ hearing and so a conditional termination agreement was not possible.
The tenant is more than 21 days in arrears and pursuant to the provisions of s55(a) of the Residential Tenancies Act 1986 her tenancy is terminated.
I note that at today’s hearing the landlord expressed a wish that the tenant continue their arrangement to pay a weekly amount for rent arrears. If that happened they would not enforce this order. Rent arrears
