Reasons

The landlord attended the hearing by video. An attempt was made to join the tenant to the hearing by telephone, but the call did not connect to the number for the tenant. The hearing proceeded in the tenant’s absence.

The landlord has applied for termination of the tenancy in reliance on section 55(1)(c) Residential Tenancies Act 1986.

Section 55(1)(c)(v) provides that the Tribunal shall make an order terminating the tenancy if the Tribunal is satisfied that the tenant has assaulted, or has threatened to assault any neighbour of the premises or of any building of which the premises constitute a part.

The premises is within a multi-story apartment complex. An incident occurred on 18 May 2024 where the tenant smashed a glass panel in the door to the complex. The landlord produced a video showing this action.

At least one other tenant had witnessed this incident and that witness provided a written statement for the Tribunal. In the statement the witness gave detail of the threatening statements that the tenant had said to her. That witness had also called the call centre on the day of the incident and the record from the call centre is consistent with the statement.

On the evidence I am satisfied that the tenant has threatened to assault a neighbour of the premises.

Section 55(1) is subject to subsection (2) which provides that the Tribunal may refuse to make an order under subsection (1) if it is satisfied that the breach has been remedied, the landlord has been compensated for any loss arising from the breach and it is unlikely that the tenant will commit any further breach of a kind to which this section applies. Subsection (2) is not relevant in these circumstances as the breach is not capable of remedy and I am not satisfied that the tenant will not commit a further breach of this kind.

The tenancy is terminated as sought.
