Order
- Grant Steven Smith owes Paul Alan Mcilwee $18,080.00 (“the debt”).
- Grant Steven Smith must pay rent and the debt as follows: a. By a payment of $10,000.00 by 30 August 2024 and b. weekly payments of $865.00, being $565.00 for rent and $300.00 for the debt until Thursday, 24 October 2024 and c. weekly payments of $975.00, being $675.00 for rent and $300.00 for the debt from Friday, 25 October 2024 d. Payments will be every Friday, with the first payment on 26 July 2024 and continuing until the full amount of arrears is paid.
- Payments will be allocated in the following order: rent and rent arrears.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 7 Hector Grove, Trentham, Upper Hutt 5018 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- The landlord has applied for termination of the tenancy and rent arrears. The tenant wants to repay the debt to avoid immediate termination. The parties have agreed to the payment plan to pay the arrears.
- If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
- I should add that the tenant was unaware of the arrears because his partner was using the rent money for other purposes and the landlord had health issues that stopped him from checking the status of rent payments. B Smallbone 24 July 2024
