Reasons

Ms Rea attended the teleconference hearing on behalf of the landlord. The phone number for the tenant, the last three digits being 412, was called twice. Both calls went to voicemail. There was no request for adjournment made by the tenant. As the tenant was served, the hearing proceeded in her absence.

The landlord has applied for termination of the tenancy and for rent arrears.

The landlord applied previously for payment of rent arrears by the tenant, in application #4665112, where a mediator’s order was made dated 28 September 2023, which was sealed on 3 October 2023. The mediator’s order provided for the tenant to repay the debt of $8,060.00 at $100.00 per fortnight, along with regular weekly rent payments, which were $490.00/week at that time. The landlord said the tenant has not complied with the terms of the mediator’s order.

The landlord said further that multiple attempts have been made to engage with the tenant through phone calls, emails, visits, but the tenant’s rent payments remain inconsistent. There are periods of between 9-14 weeks on the rent summary provided by the landlord when the tenant has paid no rent at all. The landlord said the last payment by the tenant was on 18 June 2024.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing to 25 August 2024, which is $21,940.00. Weekly rent is currently $380.00 so daily rent is $54.28. A further 6 days’ rent @ $54.28/day is payable from 26 August 2024 to 31 August 2024, for a sub-total of $325.68. Therefore, the tenant owes the landlord a total of $22,265.68 in rent to 31 August 2024, which is the end of the tenancy.

I consider the landlord has taken appropriate steps to attempt to mitigate their loss in this tenancy.
