Reasons

The landlord attended the hearing. The tenant did not.
I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend. I have tried to contact the tenant twice and left a voice message for her.
The tenant applied for the notice she received terminating her fixed term termination before the end of the fixed term be declared an unlawful notice and because the landlord allegedly attempted to terminate her tenancy without grounds.
The landlord has confirmed that on 13 May 2024, her application to terminate the tenancy (application 4859040) resulted in the Tenancy Tribunal terminating the tenancy, pursuant to section 55(1)(a) of the Residential Tenancies Act 1986 (“RTA”). The tenant’s rent was in arrears of 21 days or more at the time the landlord made her application 4859040 and was still in $3,025.00 arrears at the date of the hearing.
The landlord says the tenant did not attend the 13 May 2024 hearing, and she did not expect the tenant to attend this hearing as the tenancy had ended on 8 August 2024, when the landlord had the tenant evicted.
The Tribunal’s 14 May 2024 Order ending the tenancy and granting possession to the landlord has not been appealed by the tenant nor did the tenant apply for a rehearing. She therefore must have accepted the Tribunal had lawful grounds to end her tenancy and grant possession back to the landlord.
It is not clear to me what the basis of the tenant’s application is.
There appears to be no grounds on which she can claim her tenancy was terminated without grounds. She was in significant rent arrears, which is a breach of the RTA and her tenancy agreement. This is a breach capable of remedy, but the tenant did not remedy the breach. As a result, her tenancy was ended.
For the reasons set out above, the tenant’s application is dismissed.
