- Lisa Murray attended the hearing for the landlord by video link.
- The tenant did not attend. The Tribunal telephoned her but there was no answer. The hearing proceeded in the tenant’s absence.
- The landlord has applied for compensation for expenses and reimbursement of the filing fee following the end of the tenancy. The Tribunal released the bond to the landlord in an earlier decision dealing with termination and rent arrears. 1
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. 2
- The tenant did not leave the premises reasonably clean and tidy, left the carpets dirty and stained, and did not remove all rubbish. The landlord had to pay for contractors to clean the house, clean the carpets, and remove the rubbish.
- The tenant did not move out immediately as the Tribunal ordered on 1 July 2024. When the landlord went to the premises, it found many of the tenant’s possessions had not been removed. As a result the landlord had to pay a contractor to change the locks and keys in case the tenant returned and entered the premises without permission.
- The landlord provided invoices for the rubbish removal, cleaning, carpet cleaning, and lock and key replacement.
- The landlord has proved it expenses resulting from the tenant breaching her move-out duties. Filing fee
