The tenant or his agent, his friend “Eddie”, or any other authorised agent, have until 15 September 2024 to uplift the tenant’s belongings.
After 15 September 2024, Tamaki Housing Association Limited Partnership must: a. Take any personal documents belonging to the tenant, that have been left at the premises, to the nearest Police station and obtain a receipt for them. b. Dispose of the other goods left at the premises by the tenant by: i.selling all goods with a saleable value by public auction or by private contract at a reasonable market price; and ii.disposing of all goods with no saleable value as the landlord sees fit.
Tamaki Housing Association Limited Partnership must pay the proceeds of any sale, to the Bond Centre together with a copy of this order.

Reasons

Crystal Seluini attended the hearing for the landlord.
The tenant did not attend. The hearing proceeded in the tenant’s absence.
The landlord has applied for the disposal of goods that the tenant left at the premises at the end of the tenancy. It is not practicable to return the goods to the tenant.
Ms Seluini says that the tenant has advised that his friend, Eddie, will pick up some of his items for him, and that the landlord can dispose of the remainder of his items.
The tenant is given to 15 September to arrange for collection of the items he wants to keep.
After that date, the landlord is to deal with the goods as authorised by the tenant or in the absence of such authority, if some of the goods have a value above the cost of storing, transporting, and selling them. The landlord must sell these goods at a reasonable market price.
The landlord may deduct any amount owing from the sale proceeds and must pay the balance to the Bond Centre: ss 62(3)(b), 62B(2),(3) and (4), 62C(1)(b),(2) and (3) Residential Tenancies Act 1986).
After 15 September 2024, the landlord may dispose of any goods that have no saleable value.
