Reasons

The landlord’s representative attended the telephone hearing today.

I telephoned the tenant twice on the mobile number provided for him, but the phone went to voicemail both times.

The tenant has been posted notice of the hearing date and time, so I am satisfied he is aware of the hearing. I continued in his absence. Removal of dog from the premises and shared areas at the housing complex

The landlord seeks an order requiring the tenant to permanently remove all dogs from the tenant’s flat and from the shared areas at this housing complex.

The tenancy agreement says that the landlord may allow a tenant to keep a pet, including a dog, if the landlord thinks the home is suitable for keeping a pet.

The landlord says that this home is not suitable for keeping a dog because there is no fencing to keep the dog secure and this flat is one of 24 one- bedroom flats in the same complex.

The landlord explained this to the tenant at the start of this tenancy.

The landlord has given the tenant two notices of breach requiring him to remove the dog but says that one or more dogs have been seen at the premises after the date by which the dogs must be removed.

The landlord has proven that the tenant is not permitted to keep a dog at the tenancy address. This is a reasonable and lawful term of the tenancy contract.

I have made an order to confirm that the tenant is not permitted to have a dog at the premises.

I have also made an order that the tenant must permanently remove all dogs from the premises and any dogs in his care from the shared areas at the complex by 10:00am on Monday 16 September 2024.
