Reasons

Only the applicant landlord attended the hearing which took place by teleconference. Kate and Richard Anderson attended the hearing as directors of RLA Developments Limited. They advised that RLA Developments Limited is the owner of the property.
The landlord has applied for termination of the tenancy for abandonment and rent arrears.
Today the landlord seeks only an order for termination and possession and will file a further application in respect of rent arrears and vacated costs.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
The landlord applied for termination for abandonment on 9 August 2024. A copy of a rent summary has been provided to prove that the rent is in arrears. The landlord advised that no rent has been paid since 16 July 2024.
The landlord gave evidence that they became aware the property was abandoned on 7 August 2024 and that since then they have visited the premises multiple times and found no one living there. They advised that attempts to contact the tenant over recent weeks have been unsuccessful and she has not given notice to vacate, however, on Thursday 22 August they received a text from the tenant that she was in Christchurch and would be moving her goods on Tuesday 27 August 2024.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated as at Wednesday 28 August 2024.
