Reasons

Ms Smith, representing the landlord attended the teleconference hearing. The phone numbers for the tenant, the last three digits being 320 and 824 respectively, were called, without any response. As the tenant was served, the hearing proceeded in his absence.

Kāinga Ora–Homes And Communities claims the tenant has not allowed them entry to the premises when they were entitled to enter, and has failed to remedy breaches of his tenant responsibilities.

A landlord may enter the premises during the tenancy with the tenant's consent, in an emergency, or after giving the required notice for inspections and repairs and maintenance. See section 48(1) and (2) Residential Tenancies Act 1986.

Breaching this obligation without reasonable excuse is an unlawful act for which exemplary damages may be awarded up to a maximum of $1,500.00. See section 48 (4)(b) and Schedule 1A Residential Tenancies Act 1986.

The landlord has not sought exemplary damages in this situation, yet. The landlord had applied for costs of cleaning the property, however.

The hearing had been adjourned in a Tribunal order dated 20 September 2024, which clarified that the landlord is permitted to enter the tenancy premises to maintain the premises after giving at least 24 hours’ notice of this to the tenant. The landlord was to provide an invoice with a narrative of any cleaning completed and the cost of such cleaning, before the second hearing.

Ms Smith said the tenant has continued to refuse entry to the landlord to the premises for maintenance and cleaning, as notified by them. She said the landlord will now consider its options in terms of whether to seek termination of the tenancy, which would be dealt with in a separate application, if pursued.
