Reasons

Both parties attended the hearing. The Tenant attended by video. The Landlord attended by telephone.

The landlord has applied for termination, rent arrears and reimbursement of the filing fee following the end of the tenancy.

The Tenant applied for refund of the bond, compensation, exemplary damages and reimbursement of the filing fee.

At the hearing, the Landlord withdrew their claim for rent arrears. The Tenant also withdrew their claim for compensation.

The parties agreed that the Tenant would pay rent on time when it was due and the tenancy would terminate on 10 February 2025. Tenants claims

The Tenant claimed exemplary damages because they failed to maintain the property in that there was a cockroach infestation. The Tenant noticed this in the past few days. She had photographs however she did not notify the Landlord of this infestation.

The Landlord denied having a cockroach issue and submitted everything was renovated before the Tenant moved in so there should not have been an issue with cockroaches.

The Tenant shall notify the Landlord as soon as possible of any damage or repairs required for the property. (Section 40(1) Residential Tenancies Act 1986) (“RTA”).

In considering the evidence, the Tenant did not notify the Landlord of the issue with the cockroaches so the Landlord cannot be held responsible for remedying this issue if they were not aware of it. The Tenant is obliged to notify the Landlord. The claim is dismissed.

The Tenant claimed the bond refund however the tenancy has not ended so this will not be refunded. Landlords claims

The Landlord withdrew their claims for rent arrears however they wanted an Order which ensured the Tenant paid their rent on time.

The Tenant claimed their rent was paid by WINZ but they were agreeable to ensuring this would be paid on time when it was due.

As neither party has been substantially successful, the parties shall pay their own filing fee and name suppression is not granted to the Tenant on this occasion.
