Both parties attended the hearing. The Landlord attended by video and the Tenant attended by phone.

The Landlord sought an Order to remove the Tenant’s dogs at the property. At the time of the hearing, the Landlord estimated the Tenant had six dogs at the property which were aggressive.

The Landlord had issued the Tenant a 14-day notice requesting the dogs removal as they were not permitted pursuant to section 29 of the Tenancy Agreement.

The Tenant was devastated because the dogs were her security and safety. She had been home-invaded and was a single parent living in the property for fourteen years with her children. She only felt secure with the dogs present and she considered the landlord asking her to remove all of the dogs except one was similar to asking her to choose between her children. The Tenant had done everything to try to rehome the dogs however was unsuccessful. In any event, she submitted that she had given away five dogs and one remained at the property. The Tenant felt the request to remove the dogs equated to a request for the Tenant to put the dogs down.

Where a breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by having dogs present on the property which have not been approved by the Landlord.

The landlord served a 14-day notice on the tenant on 27 August 2024 and July 2024. The tenant did not remedy the breach within the required period.

The tenant wishes to retain three dogs.

In considering the evidence, the Tenant has breached the agreement and has not remedied the breach within 14 days or at the time of this hearing. I find the Tenant must remedy the breach by removing all the dogs which have not been approved by the Landlord. Whilst the Tribunal sympathises with the Tenants predicament in respect of her safety issues and difficulty in rehoming the dogs, the concern is the damage to the property and the aggressive nature of the dogs.

It is noted that if the Tenant does not comply with the Orders, the Landlord will consider requesting Animal Control to enforce the Order.

As the Tenant has not been successful, name suppression is not granted for the Tenant.
