This order replaces the order dated 9 January 2025. There was a calculation error in that order. The amount that Ms Malaga is to pay is $209.00 per week, being $159.00 for rent and $50.00 towards the debt. The corrected order is stated below. Apologies to the parties for this error.

Rosie Malaga owes Kāinga Ora–Homes and Communities $6,824.00 (“the debt”).

Rosie Malaga must pay the debt by making payments of $50.00 per week in addition to the usual weekly rent, which is currently $159.00 per week.

The first payment of $209.00, being $159.00 for rent and $50.00 towards the debt, is due o Thursday 16 January 2025. Payments of a minimum of $209.00 shall continue every Thursday until the debt is paid in full.

Payments will be allocated in the following order: rent, rent arrears.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 16B Norcross Avenue, Henderson, Auckland 0612 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Ms Maturan-Abuid represented Kāinga Ora. I was unable to contact the tenant on the phone number provided.

Kāinga Ora’s rent record shows that Ms Malaga has been in substantial rent arrears for a prolonged period.

The rent was more than 21-days in arrears when this application was filed and the landlord is entitled to an order terminating the tenancy immediately.

Ms Maturan-Abuid said that Kāinga Ora would accept a conditional termination order to allow Ms Malaga the chance to remain at the property provided that she consistently pays the rent and an amount towards the rent arrears every week. Ms Maturan-Abuid suggested an amount of $50.00 in addition to the weekly rent.

I agree that it is appropriate to make a conditional order in this instance.

It is critical that Ms Malaga begins paying $209.00 from Thursday next week and that she continues to pay $50.00 on top of her usual rent every week until the rent arrears debt is cleared. If she does not, Kāinga Ora can terminate the tenancy using this order, without having to come back to the Tenancy Tribunal.
