Justine Carmichael must pay Gold Property Management Limited T/A Harcourts As Agent For Rachel & Steve Wilford $27.00 immediately, being reimbursement of filing fee.
Gold Property Management Limited T/A Harcourts As Agent For Rachel & Steve Wilford must take any of the tenant’s personal documents, if any, that have been left at the premises to the nearest Police station and obtain a receipt for them.
The landlord may dispose of the other goods left at the premises by the tenant as the landlord sees fit.

Reasons

Only the landlord attended the hearing which took place by teleconference. The tenant was called on the number provided and the calls went to voicemail. The file records that the tenant has been sent notice of the hearing so the hearing proceeded in her absence.
The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.
The tenancy ended on 23 August 2024. The landlord moved the tenant’s belongings into the garage where they have been stored for more than 30 days.
The landlord contacted the tenant who returned to the premises to collect most of her goods from the garage. The landlord advised that contractors saw her at the premises last week.
The tenant has failed to collect the remainder of the goods.
The landlord has been unable to contact the tenant since last week. The property manager stated that she tried to contact her as recently as yesterday but there was no response.
It is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore, the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.
Because Gold Property Management Limited T/A Harcourts As Agent For Rachel & Steve Wilford has wholly succeeded with the claim I must reimburse the filing fee.
