Order
- By consent, the tenancy of Paris Williams and Kishan Kumar at 112 Alford Street, Waterview, Auckland 1026 is terminated, and possession is granted to Better Place Holdings Limited, at 9.00am on 31 October 2024.
- By consent, the Tenant shall pay the landlord rent arrears of $2640.00 in addition to their current rent by the following: a) $1230.00 shall be deposited in the landlord’s bank account by 23 October 2024; b) The balance shall be deposited to the Landlord’s bank account by 5 November 2024.
- By consent, the Tenants shall not unreasonably withhold access to the Landlord or their agents to the property, if sufficient notice has been provided to the Tenants as per the Residential Tenancies Act 1986.
Reasons
- Both parties attended the hearing. The Landlord and Mr Kumar. Ms Williams did not attend.
- The Landlord sought rent arrears and termination.
- By consent, the parties agreed to Mr Kumar paying rent arrears on top of the normal rent owing, as per the above Orders. The parties also consented to the Tenants vacating by 31 October 2024.The Tenant also agreed that they would provide access to the Landlord in accordance with the provisions of the Residential Tenancies Act 1986 so that the Landlord could assess any damage and repair for the next tenancy.
- As the Tenant has not been substantially successful, name suppression is not granted to the Tenant.
