Arii Taoro owes Kāinga Ora–Homes and Communities $6,949.28 being rent arrears to 31 October 2024 (“the debt”).

Arii Taoro must pay rent and the debt as follows: a. By weekly payments of $220.00, being $194.00 for rent and $26.00 for the debt. b. Payments will be every Tuesday, with the first payment on 5 November 2024 and continuing until the debt is paid in full.

Payments will be allocated in the following order: rent, rent arrears.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 50A Lancaster Road, Beach Haven, Auckland 0626 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

If the tenant’s weekly rent is reduced or increased, then the weekly rent payment set out in Order 2 above will be adjusted accordingly but the weekly payment of $26.00 for the debt will continue as ordered.

Reasons

The landlord attended the hearing by phone.

The tenant did not join the video hearing and was telephoned on the phone numbers provided but the phone calls went unanswered. I am satisfied the tenant was properly served with notice of the hearing. The hearing proceeded in his absence.

The landlord has applied for termination of the tenancy and rent arrears. The landlord assumes tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing.

On reviewing the rent summary, I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

In the event that the weekly rent amount is increased or reduced I have made provision that in such circumstances the weekly rent amount in Order 2 would be adjusted but the weekly payment for the debt would continue as ordered. Suppression

The landlord sought name suppression for the tenant.

Having regards to the interests of the parties and the public interest I have not made an order suppressing the tenant’s name. See section 95A of the Residential Tenancies Act 1986.
