Gordius Keith Maegaard, Natalie Fay Maegaard and Kent Arthur Horsfield as trustees of the Maegaard Family Trust must take any personal documents belonging to the tenant, that have been left at the premises, to the nearest Police station and obtain a receipt for them.

The landlord shall dispose of the other goods left at the premises by the tenant by: a. selling all goods with a saleable value by public auction or by private contract at a reasonable market price, and b. disposing of all goods with no saleable value as the landlord sees fit.

Gordius Keith Maegaard, Natalie Fay Maegaard and Kent Arthur Horsfield as trustees of the Maegaard Family Trust must pay the proceeds of any sale to the Bond Centre together with a copy of this order.

The landlord trustees Mr and Mrs Maegaard attended the hearing.

The tenant died on or about 5 September 2024.

The Tribunal was able to contact the deceased tenant’s second cousin and a friend who has acted as her next of kin. They believe that there is no executor for the estate nor any administrator. They had no objection to the Tribunal making the disposal of goods order which the landlord has applied for.

Due to the circumstances the landlord cannot reach any agreement for the return of the goods to any named executor, administrator, or other representative for the estate.

Some of the goods might have a value above the cost of storing and selling them. The landlord must sell those goods at a reasonable market price.

The landlord must pay the sale proceeds (if any) to the Bond Centre. See sections 62(3)(b), 62B(2),(3) and (4), 62C(1)(b),(2) and (3) of the Residential Tenancies Act 1986.

The landlord may dispose of any goods that have no saleable value.

If there are any personal documents among the late tenant’s goods such as passports or birth and marriage certificates, the landlord must take them to the nearest Police station and obtain a receipt for them.

The landlord is aware that they can make a claim against the bond for any costs they have incurred, including the filing fee on this application. Any application should be made within 2 months of the tenant’s date of death.
