Both parties attended the hearing by telephone.

The Landlord applied to remove the Tenant’s dogs, puppies and cabins from the property.

The Tenancy Agreement permitted pets conditional upon several clauses which were listed at Appendix C. These included that the Tenant had to comply with the Kainga Ora pet policy, the property was suitable, and the pets were secured when Kainga Ora or contractors attended the property.

The Landlord submitted that the dogs and puppies had not been approved and that efforts to address the issue with the Tenant had been unsuccessful. The Landlord further stated that the neighbours had complained about the dogs roaming freely, one of the puppies had been run over by a car, and the Landlord had been chased off the property by the dogs. The Landlord requested that the Tenant remove the dogs, but the Tenant refused.

The Tenant claimed they had been granted permission to keep one of their dogs 12 years ago. However, they did not provide evidence of this consent to the Court. The Tenant expressed a desire to discuss the matter with a different representative of the Landlord who was not present at the hearing.

The Landlord submitted the Tenant had an unconsented cabin which they had asked the Tenant to remove. The Tenant submitted that no one was living in the cabin and they used it for storage. The Landlord presented a letter where they had asked the Tenant for its removal and referred to section 42(1) of the Residential Tenancies Act 1986 (“RTA”) which states that cabins are only permitted if there is consent by the Landlord. Photographs of the cabin were provided.

The RTA allows Landlords to refuse the presence of dogs on a property and it is stipulated in the Tenancy agreement that dogs are only permitted with the Landlord’s consent.

In considering the evidence, the Landlord has not allowed the dogs for multiple reasons and the RTA permits this. The Tenant shall remove the dogs and puppies from the property within the next ten days.

Section 42(1) of the RTA provides that cabins maybe added to a property if the Landlord consents to it. In this case, the Landlord clearly did not agree to it and asked the Tenant to remove it. The Tenant shall remove the cabin within the next fourteen days from the property.

The Landlord and the Tenant have not sought name suppression so this is not granted.
