- Nguyen Thao, TRAN THAO, TRAN MY and PHAN HA must pay Barfoot & Thompson Limited As Agent For Sunset Investment Ltd $3,134.14 immediately, as calculated in the table below.
- The Bond Centre must immediately pay the bond of $2900.00 to Barfoot & Thompson Limited As Agent For Sunset Investment Ltd.
Reasons
- This application was scheduled to be heard by videoconference. As with the last hearing on 2 December 2024 I was unable to contact any of the tenants and so again the hearing proceeded in their absence.
- Thos order ought to be read together with the order dated 2 December 2024.
- This tenancy was a fixed term tenancy which was due to expire on 17 December 2024. The tenants are therefore liable for rent up to the 17 December 2024 or to the date of a new tenancy starting, whichever is the earlier.
- I was advised at today’s hearing that a new tenancy has not yet started because there was considerable damage done to the premises during the tenancy and time has been needed to have it repaired.
- The tenants are therefore liable for rent to 17 December 2024 and I accept the evidence that at this date rent arrears amounted to $6,007.14.
- I note that at this stage the landlord has withdrawn other claims relating to the damage to and cleanup of the premises.
- I am also ordering the tenants to reimburse the filing fee to the landlord because the landlord was wholly successful in the claim against them. C ter Haar 05 February 2025
