An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord name and identifying details.

The tenancy of Ryan Jordan Kamo at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 10:30am on Friday 22 November 2024.

The landlord must email the tenant and give him 48 hours to collect any goods left behind. If the goods are not collected within that time, the landlord may dispose of the goods as the landlord sees fit.

Reasons

The landlord’s representative attended the hearing today by telephone. I phoned the tenant’s number, but it did not connect.

The Tribunal can continue a hearing in the absence of one party if satisfied they have been given notice of the hearing. The tenant has been emailed notice of the date and time of the hearing to an email address that he used during the tenancy. I am satisfied that this is sufficient service.

The landlord has applied for termination of the tenancy for abandonment.

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 21 October 2024, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. He inspected the premises and discovered the keys left behind inside the property and most personal belongings removed.

The landlord has delivered three notices advising the tenant of rent owing and left these taped to the door. None of the notices have been moved. The landlord says he has visited the address about every second day for the last five weeks and nothing has changed.

I am satisfied the premises are abandoned.

The rent ledger shows the last payment of rent was made on 30 September 2024.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

The landlord has already received the bond of $1,540.00 and credited this to rent arrears. He does not seek any additional payment.

The landlord advises that some belongings have been left behind (a bed, kitchen items, food).

The value of the goods is below the cost of storing, transporting and selling them.

The landlord must email the tenant and give him 48 hours to collect anything he wants. If he does not do so, I authorise the landlord to dispose of all goods left behind. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.

The landlord’s name is suppressed from the published order, as sought.
