- Crystal Ann White must pay AJAI KUMAR $10,037.00 immediately, being rent arrears to 6 November 2024.
Reasons
- Only the landlord attended the hearing which was held by phone. I placed two calls to the tenant on the number provided but both calls went to voicemail. I am satisfied that the tenant has been properly served with the landlord’s application and so the hearing proceeded in the tenant’s absence.
- The tenancy began on 24 April 2024. The tenant moved out and collected all her belongings by 6 November 2024.
- The landlord has applied for rent arrears. It appears that rent payments were initially paid by WINZ but that these soon stopped. Some further lump sum payments were then made. The landlord provided a rent summary and calculations of total rent owed, and provided evidence of payments made by the tenant.
- At the hearing the landlord said that he had claim for water arrears but as there is no claim for water arrears included in this application I explained that he will need to file a further claim for water arrears.
- Because AJAI KUMAR has wholly succeeded with the claim I must reimburse the filing fee. The landlord did not seek an order for name suppression.
