Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 12 September 2024 the landlord became aware that the tenant had been remanded in custody. His rent was not in arrears at that stage. A rent payment due on 17 October was missed. A notice to remedy was sent. The landlord was in communication with the tenant’s lawyer and it was hoped that the tenant would be released on bail.

On 30 October the landlord received an email advising that bail had been declined and the tenant would be in custody until 2025. The landlord attempted to have the tenant sign an agreement confirming that the tenancy would end but has received no copy of the signed agreement.

Accordingly, On 6 November the landlord filed an application for termination. The landlord provided a rent summary showing that the rent was in arrear at the date the application was filed and an updated rent summary showing that the last payment was made on 10 October.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice.
