Order
- This order replaces the Tribunal’s orders made on 1 April 2025 and 30 May 2025. This order is the same order that was made on 30 May 2025 except that the amounts for the payment of rent and the debt have been corrected. The total of the weekly payments is unchanged.
- Stephen Corsbie owes Kāinga Ora–Homes and Communities $16,373.00 (“the debt”) being rent arrears to 4 June 2025.
- Stephen Corsbie must pay rent and the debt as follows: a. By 327 weekly payments of $370.00, being $336.00 for rent and $34.00 for the debt. b. A final payment of $343.00, being $336.00 for rent and $7.00 for the debt. c. Payments will be every Tuesday, with the first payment on 3 June 2025 and continuing until 9 June 2031.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 101 Arcon Drive, Broomfield, Christchurch 8042 will terminate, and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- Both parties attended the hearing by telephone.
- This was the hearing of the tenant’s rehearing application.
- The original order was made on 1 April 2025. It was a conditional termination order requiring the tenant to pay $370 per week to avoid termination.
- Not all the required payments were made which resulted in termination of the tenancy.
- The tenant said that he did not receive the order following the hearing and then payments were not made by ACC resulting in more payments being missed.
- Whatever the merits of this rehearing are, the landlord has agreed to a reset whereby the tenant must make payments of $370 per week to avoid termination beginning on 3 June.
- The tenant confirmed that ACC make payments into his bank account, and he then pays his rent to the landlord. It is therefore his responsibility to ensure that he has sufficient funds in his account to make the payments required under this order to the landlord. If he does not have sufficient funds to make the payments when they are due, he must inform the landlord immediately and make every effort to ensure that payments due to him are made so that he can made the required payments to the landlord.
- If the required payments are not made and the tenancy is terminated under this order, the tenant may make an application to vary this order. Such an application is unlikely to be successful unless the tenant can satisfy the Tribunal that he has made every effort to make the payments and that the payments will be made on time in future.
