The tenant has applied for a rehearing of her application that was heard on 20 March 2025. An order was issued on 25 March 2025.

As noted in that order, the tenants vacated the premises on Saturday 23 March 2024 (a year earlier), but did not remove all belongings or rubbish. On or about 2 April 2024 the landlord applied to the Tribunal for orders to dispose some goods. An order was made on 8 May 2024 for disposal of goods, the tenant having not attended that hearing.

On or about 21 January 2025, the tenant filed an application including a claim for compensation for the furniture that was disposed of before the order was made. This was heard on 20 March 2025.

On 25 March 2025, the Tribunal made an order that Property Brokers Limited pay the tenant the sum of $750 in relation to entry without consent.

The tenant’s claims relating to disposal of chattels (including chickens) were dismissed.

The application for rehearing is on the grounds that the tenant has since spoken to a person who works for Fast Forward, who undertook removal of chattels. She said that he can give evidence that the chattels were disposed of before the order was made on 8 May 2024 for disposal.

The application for rehearing was heard by phone on 27 May 2025.

The application for rehearing is dismissed on two grounds: a. The tenant had ample opportunity between 8 May 2024 and 20 March 2025, being the date of the hearing of the tenant’s application, to speak with Fast Forward and call witnesses to give evidence at the hearing. That evidence was available to her then. It is not a case of evidence later coming to light. b. As outlined in the Tribunal’s order of 25 March 2025, section 62A provides that the landlord may assess the market value of goods and if the value of the goods is less than the cost of storing, transporting and selling them, the landlord may immediately dispose of those goods in any way the landlord thinks fit.

I am not satisfied that there has been a miscarriage of justice. The tenant did not remove her belongings at the end of the tenancy. She did not attend the hearing on or about 8 May 2024 and did not attempt to call relevant evidence at the hearing of her own application 10 months later. The application for a rehearing is dismissed.
