Order
- Alapati Manuseuga shall pay Oxygen.co.nz Ltd (as agent for Juliet Jones) $10,680.00 by 5.00pm on Friday 7 March 2025.
- The payment of $10,680.00 is comprised of rent owed to Sunday 9 March 2025 ($8,900.00) plus two weeks’ rent in advance ($1,780.00).
- If the tenant fails to pay rent and rent arrears (total $10,680.00 by 5pm on Friday 7 March 2025: a. The tenancy at 150 Upper Fitzherbert Road, Wainuiomata, RD 1, Lower Hutt 5373 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately. It is noted that this remains a joint tenancy.
- In addition, Alapati Manuseuga and Cynthia Peni must pay Oxygen.co.nz Ltd $27.00 immediately, being the filing fee for this application.
Reasons
- The application sought termination of the tenancy due to rent arrears.
- The rent was more than 21-days in arrears on the date that this application was filed. The landlord is entitled to an order for termination of the tenancy. 1
- Ms Pilcher represented the landlord at the phone hearing today. Mr Manuseuga also participated in the hearing. I was unable to contact Ms Peni on the phone number provided.
- Mr Manuseuga accepted responsibility for the arrears and said that he will pay them in full. Ms Pilcher requested payment of two weeks’ rent in advance in addition to the arrears. Mr Manuseuga agreed to this.
- The payment will be made by no later than Friday 7 March 2025. Mr Manuseuga understands that the tenancy will terminate if this payment is not made in full on Friday.
- I have recorded these terms as a conditional termination order. 2
- The landlord has been successful in this application and I must also award the landlord the filing fee of $27.00. 3
