Reasons
- The landlord attended the hearing. The tenant did not attend.
- The parties are father and daughter, but the tenancy is not an excluded tenancy because they lived at separate premises.
- The periodic tenancy started on 16 September 2024.The landlord terminated the tenancy by notice dated 10 December 2024. The tenancy was due to end on 31 March 2025 Rent
- The tenant abandoned the tenancy on or about 12 February 2025 at which time she owed rent of $3,850.00.
- The landlord is entitled to a further 4 weeks’ rent in lieu of notice from the time he found the premises abandoned.
- The landlord has taken possession of the premises recently in order to prepare the place for sale. Termination and possession orders are no longer sought.
- The amount of rent owing is proved by the rent records the landlord filed in evidence. Further claims
- The landlord made an oral application to amend the Tribunal application to include lock/key replacement costs and the cost of rubbish removal. I allowed the amendment.
Did the tenant comply with her obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).
- The tenant did not remove all rubbish when she left the tenancy.
- The tenant did not return the keys.
- The amounts ordered are proved by an invoice and by the evidence the landlord gave at the hearing. Result
- The tenant will pay the landlord rent and rent arrears of $6,050.00; lock/key replacement costs of $159.96; and rubbish removal costs of $370.00.
- As the application is successful, the tenant must pay the landlord’s Tribunal filing fee.
- In total, the tenant will pay the landlord $6,060.96. Name suppression
