Reasons

The tenant was phoned twice at the time of the hearing, but calls went to voicemail on each call.

The landlord has applied for termination of the tenancy.

The landlord has requested the Tribunal to make an order under subsection 55(1)(c) of the Residential Tenancies Act 1986. That subsection provides for the Tribunal to order termination where a tenant has caused substantial damage to the premises.

On 30 April 2025, following a hearing, the Tribunal made an order that the tenant was to remove, or arrange for the removal of all pigeons that are currently living in the premises. I repeat the reasons for that order for completeness. The landlord has provided evidence that proves the tenant is unable to keep the premises reasonably clean and tidy. The premises is seriously unclean and could be determined to be currently uninhabitable for health reasons. The tenant has allowed pigeons to live in the premises. The premises is currently unoccupied because the tenant has health and well being issues. The pigeons are in the premises while the tenant is in care. The pigeons are not owned by the tenant.

The photographs show significant and ongoing damage to the premises as a result of pigeons having access to the premises.

My understanding is that the tenant has not intentionally caused a problem at the premises. It is most likely that the tenant is unable to live independently and needs to be in some form of assisted living. Suppression

The Tribunal may, on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published. (s.95A(4).

I am satisfied that there is no public interest in publishing the tenant’s name. It is appropriate to suppress. the tenant’s name and identifying details.
