The applicant has applied to the Tribunal seeking refund of her bond of $1,840.00 following the end of her tenancy.

The applicant says that the bond has never been lodged at the Bond Centre despite it being paid.

It is a legal requirement that a landlord (or other person who receives bond money on behalf of landlord) forwards the full amount to the Bond Centre within 23 working days after the payment is made. See section 19 of the Residential Tenancies Act 1986 (“RTA”).

I telephoned the Bond Centre after the hearing and an officer confirmed that there is no record of a bond being lodged for this tenancy.

The applicant has brought a claim against Haven Living Management Limited which company is named as both the landlord and agent for the landlord on the tenancy agreement. There is no other landlord disclosed.

Haven Living Management Limited is now in liquidation.

Section 248(1) Companies Act 1993 provides that no legal proceedings may be commenced against a company in liquidation without the consent of the liquidator or the High Court.

The Tribunal therefore has no jurisdiction to hear this claim until either the liquidator consents or the High Court orders otherwise.

The application must be struck out.

The tenant could contact the liquidator for advice and/or to seek their consent to this application proceeding.

I allow a period of one month within which the application may be reopened if the liquidator does consent.
