- The tenancy of Justice Mercades Kira at Unit/Flat 13A, 81 Wakefield Street, Auckland Central, Auckland 1010, Oakwood Apartments is terminated, and possession is granted to Pp And A Holdings Limited, immediately.
- Justice Mercades Kira must pay Pp And A Holdings Limited $4,227.00 immediately, calculated as shown in the table below:
- The Bond Centre is to pay the bond of $1,400.00 (3598356-023) to Pp And A Holdings Limited immediately.
Reasons
- The landlord attended the hearing which was held by teleconference on 5 June 2025. The Tribunal was unable to contact the tenant on the contact number provided. I was satisfied that adequate service of the hearing notice had been completed and proceeded with the hearing in the tenant’s absence.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing.
- As the landlord has wholly succeeded with the claim, I must order the tenant to reimburse the filing fee.
