Reasons
- The landlord attended the hearing. The tenant did not attend and did not respond despite being telephoned on the number ending in 122.
- The landlord has applied for compensation for rubbish removal costs following the end of the tenancy.
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- It is clear from the provided photographs that the tenant did not remove all rubbish at the property. The landlord was required to clean and dispose of rubbish left around the section, in the shed and food left inside the property.
- Originally the claim was for rubbish removal costs totalling $3,610.64 however on review of the evidence and discussion with the landlord, this is not a reasonable amount for what is shown. A reduced amount of $800.00 is instead awarded for rubbish removal.
- There was a rental credit of $159.00 and this has also been applied to the total amount owed.
