Reasons

The landlord attended the hearing, the tenant did not attend. I rang the tenant twice on the two mobile numbers stated in the application. The calls went to answerphone. The tenant has been served with the notice of hearing and has not communicated with the Tribunal seeking an adjournment. I am proceeding with the hearing in the absence of the tenant.

The landlord has applied for termination of the tenancy for abandonment.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On the landlord became aware on 18 February 2025 (or ought to have been aware) that the tenant had abandoned the premises. A neighbour of the tenant advised the landlord that the tenant was not living at the address and that other people were.

The landlord tried contacting the tenant with visits to the property, emails, letters, and texts. The tenant did not contact the landlord. On two occasions the landlord went to the address of the tenant’s mother. At the mothers address the tenant was spoken to. She advised some other people had taken over her property and she wanted the landlord to get rid of them.

The property was left unattended and in poor condition. To prevent further damage to the property the landlord had to have the doors and windows boarded up.

After numerous attempts to remedy the tenants breach, (of not residing at the property), the landlord made this application to the Tribunal.

Because the premises have been abandoned, the tenancy is terminated immediately.

The tenancy is terminated at 4.00pm on Tuesday 18 th June 2025 and possession is granted to the landlord immediately.

There is considerable damage and vacated costs involved with this property, but the landlord will make a further application to the Tribunal when these costs have been determined.
