Darleen Tume must pay Jessica Wedlake $210.00 immediately, as calculated in the table below:
The Bond Centre is to pay the bond of $1,290.00 (3514868-007) to Jessica Wedlake immediately.

Reasons

The landlord attended the hearing. The tenant did not attend and did not respond when telephoned on the number ending in 098.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.
The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986 (RTA). A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 14 May 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord phoned the tenant to arrange for an agent to view the property and was sent a voice note by the tenant advising that they no longer lived at the property. There was a suggestion made that others may be living there, but the landlord does not know who that may be and was not given any further information.
The landlord has been unable to contact the tenant since that date.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
The landlord did not seek the full rent arrears at the hearing and was primarily concerned with obtaining possession.
Accordingly, I have only awarded 21 days rent in accordance with s61(3) of the RTA, being rent from the date of abandonment. I have not considered any further rent and note that the landlord is therefore not prevented from filing further claims for any additional rental arrears.
Because Jessica Wedlake has wholly succeeded with the claim I must reimburse the filing fee. R Harvey-Lane 26 June 2025
