The landlord attended the hearing by telephone. The tenant did not attend the hearing. Several attempts were made to join the tenant to the hearing, but the tenant was not located on any of the phone numbers called.

After the hearing concluded an email was received from the tenant advising that all bills had been paid.

The landlord sought a conditional termination order due to rent arrears and water rates owed.

The rent summary produced for the hearing was different to the one produced with the application. It turns out that the tenant was not in arrears when the 14- day notice was issued on 19 May 2025. At the date of hearing the rent summary records that there are rent arrears of $595.00.

The landlord claimed for water rates but the summary records that four water rates invoices totalling $754.97 were sent to the tenant on 20 and 22 May 2025. This includes an invoice for water from November 2024. The tenant should be provided with water rates invoices before the amount is due to be paid.

I also note that all the invoices produced by the landlord have estimated water readings except for the invoice in April 2025 which was an actual reading amounting to $537.09. The landlord did not have details of the meter reading from when the tenancy commenced.

When considering whether to terminate this tenancy it was also noted that the bond was not lodged with the Bond Centre. It may be that the tenant had not paid the bond, but this was not clear in the application.

Due to the above inconsistencies, I am unable to make an order as sought by the landlord. The landlord has agreed to adjourn the proceedings for further evidence to be provided. The tenant is urged to be available for the next hearing even if they consider that bills have been paid.

If matters are resolved before the next hearing the landlord should consider withdrawing the application.
