Jacqueline (Jacqui) Anne Ansin must pay Alba Property Management Limited $7,726.21 immediately as set out in table below.
Reasons
- Both parties attended the hearing today, 10 July 2025.
- The landlord has applied for rent arrears and has provided rent records which prove the amount owing at the end of the tenancy on 9 June 2025. The landlord seeks an order for rent arrears to that date only.
- The landlord has also applied for an order for possession of the premises due to rent arrears and other issues. However, given that the tenant has vacated and returned possession of the premises to the landlord on 9 June 2025, no order for possession is required from the Tribunal.
- On the application filed by the landlord, the landlord has also sought an order for the bond of $10,000.00 to be paid or refunded to the landlord.
- My enquiries with the Bond Centre however indicate that no bond has been lodged with Tenancy Services and no bond number appeared on the system. Accordingly, I make no order for the bond to be refunded by the Bond Centre.
- The tenancy agreement stipulates that the bond required to be paid by the tenant is $10,000.00. The tenancy agreement also stipulates that the move-in costs (totalling $31,725.00) include a bond of $10,000.00. I assume therefore that the bond has been paid to the landlord at the start of the tenancy but (for reasons unknown) yet to be lodged with the bond centre.
- Given my findings above, I order the tenant to pay rent arrears, less the bond, as set out in the above table.
