Reasons

The hearing proceeded by way of telephone conference. Ms Luo, Property Manager, appeared for the landlord. Unsuccessful attempts were made to join Ms Smith-Nansen to the hearing. Ms Smith appeared and advised that Ms Smith- Nansen was at work and unable to attend. Ms Smith appeared for both tenants.

This is a continuation of a hearing that was adjourned part heard. At that hearing the landlord’s claim was amended to include: a. Termination of the tenancy for rent arrears. b. Lawn mowing costs. c. Water rates charges. The Tribunal has previously made an award for rent arrears to 30 July 2025 and an award for costs.

The onus of proving these claims rests with the landlord. The standard required is on the balance of probabilities. The landlord must establish more likely than not that the tenant has breached the terms of the agreement or provisions of the Residential Tenancies Act 1986 (the “Act”).

Should the tenancy be terminated?

Under section 55(1) of the Act, the Tribunal must, subject to subsection 55(2) terminate the tenancy, if at the time the application was filed, the rent was at least 21 days in arrears.

The application was filed on 9 June 2025. At the time of filing the tenant’s rent arrears totalled $5015.71. Rent was at least 21 days in arrears. The tenancy is terminated.
