Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

This is a social housing tenancy. The tenancy agreement includes the following clauses, requiring the tenant to live in the property and to advise the landlord if they are going to be away for more than 30 days:

The landlord said that the tenant is not living in the property, in breach of her tenancy agreement, and provided the following details: a. Ms Kerr was last seen at the property in November 2024. b. An annual inspection was conducted on 23 December 2024 and entry was gained via locksmith. The tenant was not at home and was not sighted at the property. c. A 14 day notice (return to property) was issued on 17 March 2025 but the tenant did not return. d. An inspection was conducted on 15 April 2025 but the tenant was not at home and was not sighted at the property. e. A second 14 day notice (return to property) was issued on 6 May 2025, expiring 30 May 2025. The tenant did not return to the property. f. This application was filed on 13 June 2025. g. A senior housing support manager has been visiting daily has there has been no sighting of Ms Kerr at the property since the application was filed.

The landlord has served a 14 day breach notice and the tenant has failed to remedy the breach.

It would be inequitable to refuse to terminate the tenancy because the tenant is not living at the property, in breach of the tenancy agreement. The property is empty and is required for other social housing tenants.
