- The tenancy ended on 20 June 2025. The Landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy: $3,268.00 (less released bond of $2,080.00) – 1,188.00.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. The house, grounds, garage and out-buildings were left dirty with extensive rubbish (estimated about 15m³). Lawns had been mown from very long grass without a catcher leaving heavy clippings; surfaces throughout were dirty and fly-spotted; there were animal faeces on the kitchen floor and a strong urine odour; drapes, windows and sills were mouldy.
- The Tenant did not return the keys. A locksmith was required at a cost of $247.75.
- The amounts ordered are proved. Reasonable and supported costs are allowed for cleaning ($400.00) and rubbish removal ($1,610.00 for four dump trips at $350.00 each plus GST), and the locksmith ($247.75). The amounts are proved.
- Because Inspire Real Estate Limited As Agent For Lemonjello Ltd has wholly succeeded with the claim I must reimburse the filing fee.
