Order

The tenancy of Waimana Paapu Justin Turu at Unit/Flat 6, 32 Tonbridge Street, Merivale, Christchurch 8014 is terminated, and possession is granted to Orbit Property Management Limited as agent for Cher Xiong, at 5pm on Sunday 17 August 2025.
Waimana Paapu Justin Turu is to pay the filing fee of $27.00 to Orbit Property Management Limited as agent for Cher Xiong immediately.

Reasons

Both parties attended the hearing. Ms Croucher attended on behalf of the landlord.
The landlord has applied for termination of the tenancy, under section 55 (1) (b) of the Residential Tenancies Act 1986 (the Act), which provides that: “55 (1) ...the Tribunal shall make an order terminating the tenancy if the Tribunal is satisfied that - ... (b) The tenant has caused, or has permitted any other person to cause, substantial damage to the premises...”
The landlord provided evidence including photographs, inspection reports and a police event summary to prove that the tenancy premises suffered substantial damage in an event on 25 June 2025.
The landlord believed that the tenant had not returned to the premises as, despite significant efforts to locate and contact him, the landlord had not been able to confirm his whereabouts.
The landlord also gave evidence that someone had attempted to clean the property and to put it back into order since the events of 25 June.
The tenant confirmed the details as described by the landlord and apologised for the damage to the property. It is clear that the tenant had been having a very difficult time over this period.
The tenant said that he had been back living at the property since 7 July and acknowledged that he had not responded to the landlord’s emails or other contact. He confirmed that he had cleaned the tenancy premises to the best of his ability but would be unable to attend to the repairs required.
The tenant acknowledged that he expected the tenancy to be terminated although that was not the outcome he hoped for.
In these circumstances, the tenancy must be terminated under s55 (1) (b) of the Act.
The landlord agreed to give the tenant additional time to arrange for somewhere else to stay prior to this tenancy ending and the date above was agreed to accordingly.
The parties also acknowledged that another hearing would likely be necessary to address costs associated with making the required repairs and that the bond would be accounted for at that time also.
As Orbit Property Management Limited as agent for Cher Xiong has wholly succeeded with the claim I must reimburse the filing fee.
