Reasons

The hearing was originally scheduled as a face-to-face hearing, and it was converted to a telephone hearing at the request of the landlord. Only the landlord’s representative attended. The landlord did not have a telephone number for the tenant, and the tenant did not provide one. He did not attend the hearing in person.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.
The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate (s56(1) Residential Tenancies Act 1986).
Where the breach is capable of remedy the landlord must first serve a notice of at least 14 days on the tenant requiring them to remedy the breach within that time and establish that the tenant has failed to do so.
The tenant has breached his obligations by not living at the premises at all times as required by the tenancy agreement.
The landlord served a 14-day breach notice on the tenant on 16 April 2025, and the tenant did not remedy the breach within the required period and still has not done so.
It would be inequitable to refuse to terminate the tenancy because the landlord is a social housing provider and there is a waiting list for its properties. Having properties lying vacant limits its ability to provide housing to people in need of it.
I note that the landlord would also have been entitled to terminate the tenancy for abandonment. There was enough evidence to support that.
The landlord has applied for rent arrears and has provided rent records to prove the amount owing.
