The tenancy of Joshua Eli Orchard at Flat 2, 414 Hereford Street, Linwood, Christchurch 8011 is terminated, and possession is granted to Kāinga Ora– Homes and Communities, at 3.30pm on Tuesday 12 August 2025.

Joshua Eli Orchard must pay Kāinga Ora–Homes and Communities $681 immediately being rent arrears to 12 August 2025.

Reasons

The hearing was conducted by telephone. Only the landlord’s representative attended. The tenant is in prison. He was made aware of the hearing, but he did not make any arrangements to attend the hearing from there. The Tribunal called both the mobile telephone numbers it had for him on file just in case. One call went straight to voicemail and the other was not connected.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, among other grounds.

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate it (s56(1) Residential Tenancies Act 1986).

Where the breach is capable of remedy, the landlord must first serve a notice of at least 14 days on the tenant requiring them to remedy the breach within that time and establish that the tenant has failed to do so.

The tenant has breached his obligations by not always living at the premises as required by the tenancy agreement.

The landlord served a 14-day breach notice on the tenant on 9 June 2025, and the tenant did not remedy the breach within the required period and still has not done so. It seems that the tenant has been in prison since mid-April 2025.

It would be inequitable to refuse to terminate the tenancy because the landlord is a social housing provider and there is a waiting list for its properties. Having properties sitting vacant limits its ability to provide housing to people in need of it.

As well as that, there are rent arrears of $681 to date, proved by a rent statement, representing eight weeks rent. The tenant has also caused serious damage to the premises. Both are grounds to terminate the tenancy.

I have therefore made an order terminating the tenancy and giving the landlord immediate possession of the premises and awarded the rent arrears.
