Order

Tierra Ngeru has until 5pm on Friday 1 August 2025 to vacate the property of her possessions and clean up the property. If she fails to do so, Heights Property Management Limited must take any personal documents belonging to the tenant, that have been left at the premises, to the nearest Police station and obtain a receipt for them.
The landlord shall dispose of the other goods left at the premises by the tenant by: a. selling all goods with a saleable value by public auction or by private contract at a reasonable market price, and b. disposing of all goods with no saleable value as the landlord sees fit.
The amount owing to the applicant out of the proceeds of any sale is as outlined in the previous order of the Tenancy Tribunal 5279040, $2,787.00.

Reasons

Both parties attended the hearing by teleconference.
The landlord has applied for the disposal of goods that the tenant left at the premises at the end of the tenancy.
The tenancy came to an end following a hearing for a large amount of rent arrears. The hearing was 23 June 2025 however the termination was extended to midnight on 27 June 2025. The tenant failed to make herself available for the previous hearing.
The tenant stated she did not have time to remove the belongings. The belongings still remain at the property. The tenant has until this Friday 1 August 20225 to be given the opportunity to remove the significant number of belongings and clean up the property.
Whilst this is not the standard practice, I am satisfied that this is a practical solution that will hopefully resolve in no further costs to the tenant and work and costs that will likely flow onto the tenant if the landlord is required to sell and dispose of the belongings.
The tenant is to contact the property manager to arrange the clean-up. Failure to do so by 5 pm Friday 1 August 2025 will result in the property being disposed disposed of as stated in the order and any application filed for the clean-up costs would be expected.
