Reasons
Should the Tribunal proceed in the tenant’s absence?
- The landlord attended the hearing. The tenant did not appear and could not be found at the courthouse.
- The tenant’s ever only known contact number has a Thai area code. The landlord has had no contact with the tenant and no other contact details since the tenant effectively abandoned the fixed-term tenancy several months early.
- Recently, the landlord requested to attend the hearing by phone. This was approved. The tenant was contacted to see if he also wanted to attend by phone, but the Registry received no response.
- The tenant was sent the notice of hearing to the email address for service provided in the tenancy agreement. A reminder of today’s hearing was also sent to the same email. Reminders were also messaged to the same number. Since the tenant was properly notified and did not request an adjournment or alternative attendance, the hearing proceeded in his absence.
- The landlord applied for rent arrears following the end of the tenancy and also asked to be reimbursed for the Tribunal’s filing fee..
