Order
- The Bond Centre is to release the bond of $2,080.00 (reference: 3781074-004) to Rent Wise Property Management Limited once the landlord submits the required forms along with a copy of this order.
- Caroline Volta Meliame Tuitalau owes Rent Wise Property Management Limited a total of $2,502.29 (“the debt”), for rent arrears up to 31 July 2025 and reimbursement of the filing fee. The breakdown is as follows:
- Caroline Volta Meliame Tuitalau must repay the debt as follows: a. 10 weekly payments of $250.00; b. A final payment of $2.29; and c. Payments must be made every Tuesday, starting 16 September 2025, with the final payment due 25 November 2025.
- If the tenant does not make a payment within five working days of the due date, the remaining balance of the debt will become immediately payable and can be enforced through the District Court.
Reasons
- Both the landlord and the tenant attended the hearing.
- The landlord applied for unpaid rent and provided rent records confirming the amounts owed. The landlord also requested that the bond be used to reduce the amount owing.
- To support a faster and more efficient recovery of the debt, the landlord advised it waives any claims for: a. rent owed after 31 July 2025; and b. potential damage compensation.
- The tenant explained her circumstances and said she wanted to repay the debt to avoid immediate enforcement. She agreed with the amounts owed and had no objection to the landlord receiving the full bond amount. She understood that missing payments could lead to enforcement action.
- The landlord accepted the tenant’s proposed repayment plan, and the Tribunal makes the order by consent.
- The landlord must lodge the necessary forms along with this order to the Bond Centre to release the bond as directed.
- Because the landlord was wholly successful in its claim, the Tribunal orders reimbursement of the filing fee in accordance with section 102 of the Residential Tenancies Act 1986.
